What conditions should the sample contract meet

According to the law, a contract is an agreement between the parties on the establishment, change or termination of civil rights and obligations and the contract is only valid when all the following conditions are satisfied:

1. 1. Contracting parties must have full civil act capacity and their representatives must be lawful.
   2. The parties to the contract must be completely voluntary, that is, from the will and desire of the parties in the agreement and it is expressed by the terms in the contract.
   3. The contents of the contract must not contrary to the law and social ethics. The subject matter of the contract does not belong to the prohibited work, the content of the contract needs to be specific, and feasible (executable).
   4. Procedures and forms of contracts must comply with certain forms and be consistent with the provisions of law for each type of signed contract.

Only when all of the above conditions are satisfied, the contract is considered legally valid and binding obligations to the related parties.

In addition, before applying a sample contract to general trading conditions on the list of goods and services subject to registration under the Prime Minister’s regulations, the sample contract and general transaction conditions shall only be applied to the consumer once the registration is completed. If one of the above conditions is not satisfied, the contract is considered void.
