On October 19, 2025, the Government submitted a draft Resolution of the National Assembly (Submission No. 958/TTr-CP) containing breakthrough changes aimed at addressing this issue.
Specifically, if the draft Resolution is approved, there will no longer be a requirement to prepare a 5-year land use plan (2026–2030) for centrally-run cities, nor to prepare land use planning and plans at the district and commune levels.
The Government explained the rationale for this addition as follows:
“Currently, centrally-run cities have organized planning in accordance with the Law on Urban and Rural Planning, and these plans already include implementation schedules. Therefore, it is unnecessary to prepare a separate 2026–2030 land use plan for these cities. Regarding district-level land use planning and annual district-level land use plans, with the new two-tier local government model, the district level no longer exists; thus, these provisions need to be removed from the Land Law.
As for commune-level land use planning and plans, they are currently implemented under Decree No. 151/2025/ND-CP in line with the two-tier local government system. However, there is no existing regulation abolishing these provisions, so it is necessary to stipulate that localities are not required to carry them out, in accordance with this Resolution.”
From a practical perspective, Lawyer Hồ Vương Quốc Sử stated: “This new point is expected to reduce overlaps and complexities within the planning system, one of the reasons for the occurrence of ‘suspended’ projects or procedural bottlenecks in investment.”

For businesses, this change may help save time and costs when accessing land, while also reducing legal risks as there will no longer be a need to reconcile multiple layers of planning. For citizens, particularly households seeking to convert land use purposes or obtain construction permits, the new regulation will help simplify procedures and shorten the time required to process applications.
It is evident that this represents a breakthrough adjustment in land management, moving towards a more streamlined, transparent, and efficient mechanism that balances state management requirements with the practical needs of society.
Moreover, this new point carries many positive implications, helping reduce administrative burdens and avoid the long-term “suspended” planning situation. Reforming the land use planning and planning mechanism is an important step to reduce overlaps, enhance transparency, and improve land use efficiency.
“However, citizens and businesses need to promptly grasp the new regulations in order to seize opportunities and minimize legal risks,” emphasized Lawyer Hồ Vương Quốc Sử.
